JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-12-2018 The petitioner seeks regular bail in connection with Kadwa P.S. Case No. 284 of 2018, registered for offences punishable under Sections 323, 341, 324, 307, 448, 504, 506/34 As per allegation, the petitioner has assaulted the nephew of the informant by iron rod causing injury to him. Submission of learned counsel for the petitioner is that there is case and counter case between the parties and land dispute also and the petitioner is in judicial custody since 10.08.2018.
Heard learned A.P.P. as well as learned counsel for the informant, they have opposed the prayer for bail of the petitioner stating that the injury was found to be grievous that too on the head.
Patna High Court Cr.Misc. No.64297 of 2018(3) dt.04-12-2018 2/2 Having heard both sides, in view of the above facts, at this stage, I am not inclined to grant bail to the petitioner. But, once the charge has been framed against the petitioner, the learned Trial Court shall release the petitioner on bail to his own satisfaction.
