The petitioner seeks bail in a case instituted for the offences under Sections 279, 413, 414, 418, 419, 420, 465, 467, 120B of the Indian Penal Code.
Prosecution case, in short, is that the accused persons were driving the vehicle rashly and on chase, they were arrested by the police.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 20.4.2019 and has got no criminal antecedent. Charge-sheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. As per prosecution, the
Patna High Court CR. MISC. No.40885 of 2019(2) dt.03-07-2019 2/2 motorcycle in question is said to be stolen property. From perusal of Annexure-2, it is evident that the motorcycle in question belongs to Raj Kishore Kumar who is relative of the petitioner. The same motorcycle is not a stolen property. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Kotwali P.S. Case No. 334 of 2019, G.R. No. 3081 of 2019. (Sudhir Singh, J) Pankaj/- U T
