The petitioner has filed the instant application for grant of regular bail in connection with Begusarai Mufassil P.S. Case no. 638 of 2019 registered under sections 25(1-B)(a), 26(2) and 35 of the Arms Act.

As per allegation in the F.I.R., a loaded country made pistol with two live cartridges are stated to have been recovered from the sand near the house of the petitioner and it is stated that the said weapon was used in the crime for which case no. 630 of 2019 was registered.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his

Patna High Court CR. MISC. No.40840 of 2020(2) dt.09-02-2021 2/2 possession and he is in custody since 05.12.2019. The application for bail is opposed by learned A.P.P. for the State who submits that the petitioner has criminal antecedent.

Having heard learned counsel for the parties, in view of the fact of the petitioner being in custody since 05.12.2019, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Begusarai Mufassil P.S. Case no. 638 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai.
