The petitioner apprehends his arrest in Barh P.S. case No.372 of 2015 under Section 304B/34 of the Indian Penal Code and under Section 3⁄4 of Dowry Prohibition Act. The informant alleged that after marriage husband of her daughter started demanding dowry and for that he was subjecting his daughter to different sorts of torture. The daughter of the informant came to his house and committed suicide. The learned counsel for the petitioner submits that, of course, the petitioner is husband of the deceased but he never demanded any dowry. The wife of the petitioner committed suicide in her Naihar and there is no instigation on the part of the petitioner but it appears that being driven out for non fulfillment of
Patna High Court Cr.Misc. No.41473 of 2016 (3) dt.12-01-2017 2/2 demand of dowry from the house of petitioner the deceased committed suicide and it was the petitioner, who was demanding dowry, and thereafter the deceased committed suicide, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
