Petitioner, who is in custody, seeks bail in connection with P.R. Case No. 41/18-19 arising out of Special Case No. 234 of 2018 registered for the offences punishable under Section 30(A) of the Bihar Prohibition and Excise Act, 2016. Allegation against the petitioner is of recovery of 120.90 liters of English wine from the vehicle of the petitioner. It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. The vehicle where alleged recovery was made does not belong to petitioner and he had no knowledge about the liquor. Petitioner has no criminal antecedent and is in custody since 10.09.2018.

No.67073 of 2018(4) dt.26-11-2018 2/2 Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cum-Special Judge (Excise), Kishanganj, in connection with P.R. Case No. 41/18-19 arising out of Special Case No. 234 of 2018.
