The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 385, 387 of the Indian Penal Code.
The prosecution case is that the petitioner being neighbour of the informant demanded extortion. It is submitted by the learned counsel for the petitioner that even assuming accusation at best, case under Section 385 is made out, which is bailable. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of
Patna High Court Cr.Misc. No.55834 of 2015 (2) dt.09-12-2015 twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Kashim Bazar P.S. Case No. 158 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
