JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-06-2018 Heard Mr. Sujeet Kumar Sinha, learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the respondents.

In view of the subsequent development when the matter was taken with regard to absorption of the teaching employees of the college made constituent in fourth phase the college in question, namely, Jamalpur college, Jamalpur within the territorial jurisdiction of the then Tilka Manjhi Bhagalpur University was made constituent in fourth phase and after series of litigation the case of the petitioner was finally recommended by justice S.B. Sinha (Retd.) Commission and

Patna High Court CWJC No.3756 of 2008(34) dt.19-06-2018 2/2 recommendation of the justice S.B.Sinha (Retd.) Commission was accepted recently by the Apex Court.

In view of the recommendation of the justice S.B. Sinha (Retd.) Commission approved by the Apex Court, there is no point to keep this matter pending. The entire issue was deliberated upon by justice S.B. Sinha (Retd.) Commission and as such the writ petition is disposed with a direction to the Tilkamanjhi University, Bhagalpur or Successor University namely Munger University, Munger to take decision in the light of recommendation of the justice S.B. Sinha (Retd.) Commission which has been approved by the Apex Court within a maximum period of 60 days from the date of the receipt/ production of a copy of this order.

It is needless to state here that the university will ensure payment of consequential benefit including monetary benefit to the petitioner in the light of the recommendation of justice S.B. Sinha (Retd.) Commission as approved by the Apex Court.

With the aforesaid, the writ petition stands disposed of.
