JUSTICE DINESH KUMAR SINGH ORAL JUDGMENT (Per: HONOURABLE THE ACTING CHIEF JUSTICE) Date: 11-01-2017 The prayer in the present writ application is to issue a direction to the respondent authorities to demolish the illegal constructions over the public passage situated in the village Machhariyava, Plot No. 1512, P.S.-27, Khata No. 137, P.S. - Fatuha, District - Patna.

2. In the supplementary counter affidavit dated 30.08.2016 filed on behalf of respondent no. 7, it has been stated that the encroachment on the land in question was removed on 17.08.2016. The process of removal of encroachment was peaceful and videographed.

3. In view of the uncontroverted assertions in the supplementary counter affidavit, we find that no further direction is necessitated in the present writ application. Accordingly, the present writ application is dismissed.

4. However, we may observe that the respondents shall ensure that the land is not encroached again by the anti-social elements.
