Patna High Court Cr.Misc. No.53162 of 2015 (2) dt.24-11-2015 2/3 and the State.
The petitioner Shravan Mahto being the husband of the victim and petitioners Jaipati Devi and Yogendra Mahto being the parents of Shravan Mahto are apprehending their arrest in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code. The accusation is of killing the daughter of the informant after three years of the marriage for nonfulfillment of the dowry demand. It is submitted by learned counsel for the petitioners that the accusation is omnibus and general. Though, from the impugned order it appears that the dead body was found thrown in the field with some injuries. Considering the thrust of accusation against the husband of the victim, the anticipatory bail application of Shravan Mahto being the husband of the victim is hereby rejected.
So far as the petitioners Jaipati Devi and Yogendra Mahto are concerned, since the accusation is omnibus and general and they happen to be parents of the husband of the victim, let they be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a
Patna High Court Cr.Misc. No.53162 of 2015 (2) dt.24-11-2015 3/3 period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sonbarsa P.S. Case No. 135 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
