The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 386, 120B, 307 of the Indian Penal Code and 27 of the Arms Act. The prosecution case is that the informant was sitting at his door when all the accused persons came and on the order of petitioner no.1, Shatrughna Singh, petitioner no.4, Chandan Singh pointed rifle on the temple of the informant and, thereafter, petitioner no.5, Kundan Kumar Singh, fired on the informant with country made pistol but did not hit him whereas other accused persons assaulted the informant with fists and slaps. Patna High Court Cr.Misc. No.54197 of 2015 (2) dt.30-11-2015 2/2 alleged that petitioner no.2 Baliram singh took signature of the informant on a plain paper.

It is submitted by learned counsel for the petitioners that no injury was caused to the informant. The accusation has been levelled in the background of pending Title Suit No.26 of 2014. Though, 107 Cr.P.C. proceeding is also initiated between the parties. Moreover, a statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Chapra in connection with Baniyapur P.S.
