The petitioner seeks bail in a case registered for offences punishable under Sections 30 (a)(g) and 32(2) of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 384 bottles containing in all about 116 litres of foreign liquor were recovered from the Scorpio vehicle and another person was apprehended. Petitioner is said to be owner of the vehicle, however, he was not apprehended from the spot. It is contended that on the date of recovery, the petitioner was in custody in connection with Karma Tarn (Jamtar) P.S. Case No.10/15 and he has been remanded on 28.08.2017 in this case. Patna High Court Cr.Misc. No.54513 of 2017(2) dt.23-11-2017 2/2 the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge -II, Banka in connection with Chandan P.S. Case No. 148/16 with a further condition that one of the bailors must be belonging to the State of Bihar.
Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
