An order, dated 05.06.2015, is under challenge in the present criminal revision application, which has been passed in exercise of power under Section 144 of the Code of Criminal Procedure, 1973 (hereinafter referred to as „the Code‟) by learned Sub Divisional Magistrate, Pakridaya, East Champaran.

The effect of the order is that the petitioner has been restrained from blocking the land in question and thereby causing obstruction in free passage.

In view of the fact that the said order, passed under Section 144 of the Code, has lost its force after

Patna High Court CR. REV. No.933 of 2015 (2) dt.04-05-2017 2/2 expiry of two months from the date of the order, in view of sub-section (4) of Section 144 of the Code, no purpose would be served by interfering with the impugned order. Section 144 (4) of the Code reads thus:

"144 (4).- No order under this section shall remain in force for more than two months from the making thereof:"
