2. The petitioner seeks pre-arrest bail in connection with Jakkanpur P.S. Case No. 219 of 2022 registered for the offence(s) punishable under Sections 406 & 420 of the Indian Penal Code and Section 138 of N.I. Act.

3. As per the allegation made in the FIR, the informant gave Rs.10,80,000/- to the petitioner on different occasions for different purpose by way of cheque and cash. Thereafter, a cheque of rupees four lacs was issued by the petitioner to the informant but the same was dishonourned by the Bank.

4. Both the parties have jointly informed that they are ready to resolve their dispute amicably, outside the Court, by way of mediation. The case as per the requirement of Section 138 of N.I. Act.

5. Considering the nature of allegation, the matter can be negotiated between the parties. I find it proper to direct the learned Mediator, District Mediation Centre concerned to resolve the dispute between the parties and submit a report before the learned District Court, well within a period of one month after appearance of the parties.

6. Both the parties are directed to appear before the learned Mediator, District Mediation Centre on 07.01.2025 at 04:30 PM.

7. In the meantime, the petitioner, above named, is directed to be released on provisional pre-arrest bail for a period of two months, in the event of his arrest or surrender before the learned District Court within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial MagistrateVIII, Patna , in connection with Jakkanpur P.S. Case No.219 of 2022, subject to the condition as laid down under Section 438(2)

8. In case, the parties resolve their dispute amicably, the provisional bail granted to the petitioner shall be made absolute on such terms and conditions as the learned District Court deems fit and proper.
