JUSTICE BIRENDRA KUMAR ORAL ORDER 09-01-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Pirbahore (Patna) P.S. Case No. 459 of 0217 a case under Sections 274, 275, 276, 284, 379, 419, 420, 467 & 120(B) of Drugs and Cosmetics Act, 1940 and Section 7 of Essential Commodities Act. From possession of this petitioner spurious drugs were recovered including Atorva 200 mg. tablets, for which he did not so any paper. Charge sheet has already been submitted in this case and petitioner is in custody since 30.08.2017. After hearing the parties and nature of allegation, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail is refused.
