Versus
1. The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :
For the Petitioner/s : Mr. Kritu Verma, ADvocate For the Opposite Party/s : Mr. Prem Kumar Jha (APP) ====================================================== CORAM: HONOURABLE MR. JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 08-11-2017 Heard learned counsel for the petitioner and the learned counsel representing the State.
The petitioner wants to renew his prayer of bail which was earlier rejected vide order dated 23.03.2017 passed in Cri. Misc. No. 10644 of 2017, on the ground that the petitioner is suffering in custody since 24.09.2016. The medical evidence does not support the prosecution version. The victim has been found aged about 19-20 years and no sign of rape was found and further no injury was found on the person of the informant. Up till now six prosecution witnesses have been examined, but the trial has not been concluded. The petitioner has been implicated in a false case with dirty politics and, as such, he deserves sympathetic consideration.
Patna High Court Cr.Misc. No.51592 of 2017 (3) dt.08-11-2017 2/2 The learned A.P.P. seriously opposes the prayer of bail.
In the facts and circumstances stated above, finding no good ground for reconsideration of prayer of the bail, again prayer of the bail of the petitioner stands rejected. However, the trial court is directed to expedite the trial and to conclude the same, preferably within four months from the date of receipt/production of a copy of this order after taking the same on priority basis.
