Mr.APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-06-2021 Heard Mr. Javed Aslam, learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Gopalganj Town P. S. Case No. 650 of 2018, instituted for the offences under Sections 414, 420, 467, 468, 469, 471, 472, 473 and 120B of the Indian Penal Code.

The Block Development Officer of Gopalganj Sadar has lodged this case alleging that on information to the police party about a person keeping wherewithals for making documents regarding transportation vehicles,

From there, many incriminating documents and wherewithals for forging such documents were recovered. The petitioner, it has been argued, has not been named in the F.I.R. After four months of the lodging of the F.I.R., the name of the petitioner has been taken by one Kamla Devi and that is the basis for prosecuting the petitioner in this case. Perhaps, the petitioner is suspected to be one of the members of the gang of Yogendra Pandit. However, this suspicion is without any foundation. The learned counsel for the petitioner has submitted that there is no recovery from him and that prior to the lodging of the present case, the petitioner was not made accused in any case up till now whatsoever.

Considering the afore-stated facts, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date

No.40144 of 2020(2) dt.09-06-2021 3/3 of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Shri Udai Pratap,, Judicial Magistrate 1st Class, Gopalganj, in connection with Gopalganj Town P. S. Case No. 650 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C.

However, it is made clear that the petitioner shall participate in the investigation if the investigation is still continuing and his non-cooperation in the investigation would render his bail liable to be cancelled. The application stands disposed off.
