The petitioner seeks bail in connection with Dalsingsarai P.S. Case No. 141 of 2017 dated 18.05.2017 instituted for the offences under Sections 304(B)/34 of the Indian Penal Code.

The petitioner is the mother-in-law of the deceased. In the F.I.R., general and omnibus allegation has been made against all the accused persons including the petitioner. It has been submitted on behalf of the petitioner that the deceased has two minor children, who are being looked after by the petitioner in jail. In para 11 of the petition, it has specifically been stated that both the children of the deceased who are aged about one year and two and half years respectively are perforce residing in jail

Patna High Court Cr.Misc. No.55596 of 2017 (2) dt.30-11-2017 2/2 along with their grandmother.

Regard being had to the aforesaid facts and also taking into account the period of custody of the petitioner which is from 26.07.2017, this Court is inclined to grant bail to her. The petitioner above named is directed to be released on bail on her furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Dalsingsarai (Samastipur) in connection with Dalsingsarai P.S. Case No. 141 of 2017.
