The petitioner seeks bail in connection with Sessions Trial No.303 of 2017, arising out of Laukahi P.S. Case No.70 of 2011, registered under Sections 302/34 and 120(B) of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that, earlier, the prayer of the petitioner for grant of bail was rejected thrice by this Court, lastly, vide order dated 26.09.2018 passed in Criminal Misc. No.56450 of 2018, wherein this Court directed the trial court to conclude the trial of the petitioner within eight months by taking all effective steps to secure the attendance of the witnesses with liberty to the

Patna High Court CR. MISC. No.53438 of 2019(4) dt.16-10-2019 2/2 petitioner to renew his prayer for bail, if the trial is not concluded within the stipulated period. While the period of more than one year already elapsed of passing of the aforesaid order dated 26.09.2018 passed in Criminal Misc. No.56450 of 2018 by this Court but the trial of the petitioner has not been concluded as yet. The petitioner is in custody since 19.07.2014. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-VI, Madhubani, in connection with Sessions Trial No.303 of 2017, arising out of Laukahi P.S. Case No.70 of 2011.

Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner. (Rajendra Kumar Mishra, J) P.S.
