JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-05-2023 The present writ petition has been filed seeking the following reliefs:- "1(i). For quashing the notice of encroachment passed by the Circle Officer, Jagdishpur, dated 26.5.2022, against the petitioners.

4/4 (ii). For quashing the entire proceeding of encroachment started by the Circle Officer in Rajaswa Thana No. 175, Khata No. 99, Khesra No. 19 & 37, Anchal-Jagdishpur, District-Bhagalpur." At the outset, the learned counsel for the petitioners submits that the Respondent-State has filed a counter affidavit, wherein in paragraph no. 12, it has been stated that the Respondents have initiated steps for settlement of the land in question and a proposal to the said effect has been forwarded to the Deputy Collector, Land Reforms, Sadar, Bhagalpur, for needful action in view of the fact that the petitioners are landless persons, hence, it is submitted that the petitioners be granted liberty to approach the Deputy Collector, Land Reforms, Sadar, Bhagalpur, for passing of necessary orders. Liberty, so sought, is granted.
