The petitioner is apprehending arrest in a case registered for the offences punishable under sections 147,148,149,307,323,325,332,333,341,342,337,338,353,379,427,4 35,504,506 of the Indian Penal Code and section 3 and 4 of Prevention of Damage to the Public Property Act. The prosecution case is that the public was making protest against the occurrence of dacoity in Kurtha bazar when the police came on the spot then Tata Sumo vehicle of the police was damaged. It is also alleged that the accused persons assaulted the police force and snatched rifle. During investigation, it transpired that the petitioner snatched cartridges.

Subsequently, the accusation was developed that the petitioner snatched cartridges. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Makhdumpur (Tehta) P.S. Case No. 143 of 2015 pending in the court of learned CJM, Jehanabad. This application is disposed of with the aforesaid observation/direction.
