The petitioner seeks bail in connection with Sasaram (Town) P.S. Case No. 382 of 2017 registered under Section 379 of the Indian Penal Code.

Motorcycle of the informant is said to have been stolen by some unknown miscreants.

It is submitted by learned counsel for the petitioner that the petitioner is neither named in the FIR nor any incriminating article has been recovered from his conscious physical possession. He has been falsely implicated in the case at the instance of his enemies. There is no legal evidence in the case

Patna High Court Cr.Misc. No.51439 of 2017 (3) dt.22-12-2017 2/2 diary indicating complicity of the petitioner in the occurrence barring his confessional statement. Though, on the basis of his confessional statement, stolen motorcycle has been recovered from the house of Saroj Kumar, but regarding said recovery Sasaram (M) P.S. Case no. 473 of 2017 was instituted and the petitioner has been enlarged on bail in that case. The petitioner has been languishing in custody since 17.07.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (Town) P.S. Case No. 382 of 2017.
