The petitioner seeks bail in connection with Kharagpur (Shampur) P.S. Case No. 135/2016 dated 01.08.2016 instituted for the offences under Sections 341, 307, 504/34 of the Indian Penal read with Section 27 of the Arms Act.

The petitioner, because of old enmity, is alleged to have fired at the informant, injuring him at the right side of the chest below the ribs.

Learned counsel for the petitioner has drawn the attention of this Court to the fact that earlier the petitioner had filed a case against the informant for the offence under Section 307 of the Indian Penal Code. Though, the petitioner has criminal antecedents, but the nature of accusation in all such cases are for

Patna High Court Cr.Misc. No.55600 of 2017 (2) dt.30-11-2017 2/2 lesser offences and in all cases, lodged against him earlier, he is on bail. Learned counsel for the petitioner has also stated that the informant is also not a person of clean antecedent and is an accused in several cases.

The petitioner is in custody since 12.07.2017. Considering the aforesaid facts, the petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IV, Munger in connection with Kharagpur (Shampur) P.S. Case No. 135/2016.
