Petitioner seeks bail in a case registered for the offences punishable under Sections 272,273/34 of the Indian Penal Code and 30(a) Bihar Prohibition and Excise Act, 2016. Foreign liquor was allegedly recovered from the house and motorcycle of two different person. Submission is that nothing was recovered from possession of the petitioner. Name of the petitioner has surfaced in the confessional statement of co-accused. Petitioner has got no criminal antecedent.
Considering the facts aforesaid, let the petitioner, above named, be released on bail after completion of investigation on furnishing bail bond of Rs.20,000/- (Twenty
Patna High Court CR. MISC. No.40138 of 2019(2) dt.01-07-2019 2/2 Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Madhepur Police Station Case No.101 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
