The petitioner seeks bail in Jamui P.S. Case No. 174 of 2017 registered under Sections 147, 148, 149, 341, 323, 325, 332, 337, 338, 353, 504, 506, 427 and 307 of the Indian Penal Code and Section 27 of the Arms Act.

250 persons including the petitioner by forming an unlawful assembly have obstructed the police in discharging their duties in releasing the person illegally confined by them and pelted stones and also resorted firing causing injury to SDPO and also damaged the police vehicle.

It is submitted by learned counsel for the petitioner that the allegation levelled against the petitioner is not specific rather omnibus in nature. The petitioner happens to be member of

Patna High Court Cr.Misc. No.53631 of 2017 (2) dt.09-11-2017 2/2 the mob. He has been languishing in custody since 06.06.2017. Similarly situated co-accused, namely, Tinku Mahto, Manjit Kumar and Raj Kumar Pandit have been enlarged on bail by a coordinate bench of this court vide order dated 08.08.2017 passed in Cr. Misc. No. 35602 of 2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S. Case No. 174 of 2017.
