2. The petitioner seeks regular bail in the present case registered for the offence under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
3. As per the prosecution case, 60 liters of illicit liquor has been recovered from E-rickshaw.
4. Learned counsel for the petitioner submits that petitioner is quite innocent and he is in custody since 24.02.2024.
5. Learned A.P.P. has vehemently opposed the prayer for bail.
6. Considering the aforesaid facts and
Patna High Court CR. MISC. No.45673 of 2024(2) dt.03-07-2024 2/2 circumstances, this application for regular bail is allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned 3rd Exclusive Special Excise Court, Saran at Chapra/concerned Court below in connection with Excise Sadar P.S. Case No. 43 of 2024 subject to condition that:- 7(i). The petitioner will mark his attendance at the Chapra Town Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
