2. The petitioner seeks regular bail in connection with Jandaha P.S. Case No. 155 of 2025 registered for the offence under Sections 317(4), 317(5), 338, 336(3), 340(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution case, the allegation against the petitioner is that he was riding a stolen motorcycle and he along with others is accused of attempting to snatch gold chain from a woman and on hulla, they have been caught and beaten by the public. On search, one country made pistol loaded with a cartridge and two bullets have been recovered.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. The
Patna High Court CR. MISC. No.43078 of 2025(2) dt.16-07-2025 2/2 petitioner is in custody since 12.04.2025. The learned counsel for the petitioner has further submitted that the motorcycle is in the name of the father of the petitioner and the recovered country made pistol is a planted one.
5. Learned A.P.P. appearing for the State has vehemently opposed the prayer for bail.
6. Considering the fact that the motorcycle belongs to the petitioner and the recovery is doubtful, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate-VII, Vaishali at Hajipur/concerned Court below in connection with Jandaha P.S. Case No. 155 of 2025.
7. Accordingly, this application for regular bail stands allowed.
