JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-12-2022 The present writ petition has been filed seeking the following relief :- " (i) For issuance of appropriate writ in the nature of mandamus for commanding and directing the respondent authorities concerned to pay ex-gratia assistance of Rs.

4,00,000/- (Rs. Four Lakh) to the petitioner on account of death of her husband namely, Palbabu Yadav, resident of village - Machhaut, Post Office - Machhaute, Police Station Daraunda, District Siwan, due to Corona disease (Covid-19).

(ii) For issuance of an appropriate writ in the

Patna High Court CWJC No.11467 of 2022(2) dt.21-12-2022 2/3 nature of mandamus for commanding and directing the respondent authorities concerned to consider the genuine claim of the petitioner for payment of ex-gratia assistance of Rs 4,00,000/- (Rs. Four Lakh) to the petitioner, as after the death of her husband Late Pal Babu Yadav, there is no one in the family to economically support her and she is unable to meet her day-to-day expenses.

(iii) For issuance of an appropriate writ in the nature of mandamus for commanding directing the respondent District Magistrate, Siwan to dispose of the representation of the petitioner sent through speed post on 12.07.2022, by which, she has requested for payment of Rs. 4,00,000/- as ex-gratia assistance after death of her husband due to corona disease (Covid -19), as per the welfare of the Govt. of Bihar."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the District Magistrate, Siwan for redressal of his aforesaid grievances. Liberty so sought, is granted.

It is needless to state that in case, appropriate representation is filed by the petitioner within a period of four weeks from today, the District Magistrate, Siwan shall take

Patna High Court CWJC No.11467 of 2022(2) dt.21-12-2022 3/3 needful action thereon, with a view to redress the grievance of the petitioner, by passing appropriate orders, in accordance with law, within a period of 08 weeks, thereafter. The writ petition stands disposed off on the aforesaid terms.
