JUSTICE BIRENDRA KUMAR ORAL ORDER 10-01-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Laheri P.S. Case No. 462 of 2017 a case under Sections, 420, 414, 379 of the Indian Penal Code, pending in the Court of Chief Judicial Magistrate, Nalanda at Bihar Sharif.

The petitioner and three others allegedly, rushed into the ATM Booth, whereas the bona fide consumers were standing in line. Thereafter, the police suspected and recovered 7 ATM cards from the possession of the petitioner. The recovered ATM cards were not of the petitioner. There is no reason that why the police will falsely put 7 ATM cards, which is said to be recovered from possession of the petitioner.

Patna High Court Cr.Misc. No.59450 of 2017 (3) dt.10-01-2018 2/2 Considering the nature of economic offence, lodged against the petitioner, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail is refused. The learned trial Court is directed to expedite the trial and conclude the same within seven months, failing which the petitioner would be at liberty to renew the prayer for bail before the trial judge itself, who shall pass a reasoned order.
