The petitioner is apprehending arrest in a case registered for the offences punishable under Section 290 of the Indian Penal Code and 47a of the Excise Act.

The house of the petitioner was raided when Kapil Choudhary brother-in-law of the petitioner was apprehended and 40 litres country made liquor was recovered. It is submitted by learned counsel for the petitioner that recovery has been made from the joint family house and the petitioner is a disabled persons having no criminal ancident. The aforesaid facts constitute ground for consideration of prayer for regular bail. Let the learned Court

Patna High Court Cr.Misc. No.54481 of 2015 (2) dt.02-12-2015 2/2 below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Sabour P.S. Case No.174 of 2015, pending before the learned Judicial Magistrate, 1st Class, Bhagalpur. With the above observation, this application is, accordingly, disposed off.
