Petitioner has filed this application for modification of order dated 10.05.2019 passed in Criminal Miscellaneous No. 31405 of 2019 whereby the petitioner was directed to surrender before the learned lower Court within four weeks and furnish bail bond.

Learned counsel for the petitioner has sought extension of time for surrender before the learned lower Court submitting that the petitioner happens to be labourer. He was living outside the State in connection with his livelihood. He fell seriously ill. Due to said reason he could not reach to his native

Patna High Court CR. MISC. No.40802 of 2019(2) dt.03-07-2019 2/2 place and surrender before the learned lower Court in compliance of the order of this Court within stipulated period. Having regard to the facts and circumstances of the case, petitioner is directed to surrender before the learned lower Court and furnish bail bond within four weeks from today. Accordingly, the order dated 10.05.2019 passed in Criminal Miscellaneous No. 31405 of 2019 is modified to the extent as indicate above and this application is disposed of.
