JUSTICE ANIL KUMAR SINHA ORAL ORDER 07-04-2021 Heard Mr. Ashok Kumar Mishra, learned counsel for the petitioner and Mr. Jharkhandi Upadhyay, learned Additional Public Prosecutor appearing for the State through video conferencing.
Petitioner seeks regular bail in connection with Rosera P.S. Case No. 220 of 2020 registered for the offence punishable under Section 414 of the Indian Penal Code 1860. The allegation against the petitioner is that one stolen Yamaha Motorcycle was recovered from the side of the house of the petitioner and the same was allegedly purchased by the petitioner from Nitish Sahni.
Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he has not

Learned counsel further submits that the petitioner purchased the said Motorcycle as a bona fide purchaser and was not aware about the fact that the same was stolen one. Learned counsel next submits that the petitioner is in custody since 26.7.2020 and charge sheet has already been submitted in the matter.
Having regard to the submissions made by the parties and taking into consideration the materials on record, the nature of allegation and the fact that the petitioner has got no criminal antecedent, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Rosera, Samastipur, in connection with Rosera P.S. Case No. 220 of 2020.
It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding social distancing.
