JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 341, 307, 379, 448 and 504 of the Indian Penal Code. The specific accusation against the petitioner and one Kamindra Yadav is to have assaulted with farsa to the informant when co-accused Ganesh Yadav assaulted with rod on the hand of the informant and when Devchandra Yadav came to rescue, he was assaulted by the accused persons when accused persons also committed theft of `50,000/- and jewellery.
It is submitted by learned counsel for the petitioner that there is no accusation of repeating the blow and in the background of land dispute, the accusation has been levelled and petitioner's
Patna High Court Cr.Misc. No.56406 of 2015 (2) dt.11-12-2015 2/2 side lodged Biraul P.S. Case No. 97 of 2013 against the informant's side at earlier point of time.
The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Biroul P.S. Case No. 250 of 2014 pending in the court of learned SDJM, Biroul (Darbhanga). Accordingly, the application is disposed of.
