This application for grant of regular bail arises out of Andharatharhi P.S. Case No. 76 of 2019, disclosing offences punishable under Sections 413 and 414 of the Indian Penal Code.
The petitioner is in custody since 08.10.2019. He had earlier approached this Court for grant of regular bail, which was rejected by an order dated 02.03.2020 passed in Cr. Misc. No. 10612 of 2020.
According to the prosecution's case, from possession of the petitioner and other two co-accused persons three stolen motorcycles were recovered.
Learned counsel for the petitioner has submitted that
Patna High Court CR. MISC. No.4559 of 2021(2) dt.25-01-2021 2/2 there is no material to suggest that the motorcycle recovered from the petitioner's possession was a stolen one. He has further argued that as the charge-sheet has been submitted and the petitioner undertakes to appear before the Court below as and when required in connection with the case in hand, he may be granted the privilege of regular bail.
As the petitioner has remained in custody for more than a year and according to the learned counsel for the petitioner, there is no substantial progress at the trial, this application is allowed.
Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Madhubani in Andharatharhi P.S. Case No. 70 of 2019.
