JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 06-12-2017 The relief which is being sought in the present application is that the father's name of the petitioner entered in the mark sheet of Class-12 issued by the Central Board of Secondary Education (CBSE) and all other connected records be corrected since the same has been misspelt. It is the case of the petitioner that his father's name is 'Masoom Reza' whereas the name which has been entered in the mark sheet is 'Masoom Raza'. It is not in dispute that father's name of the petitioner has been correctly spelt in the 10th Examination Certificate issued by the CBSE as

The petitioner had filed an application for such correction which has been rejected on the ground of the same is being time barred in view of a circular of the C.B.S.E. earlier issued. According to the said circular, one year maximum period was prescribed for seeking correction in the name of the date of birth on which ground the petitioner's case has been rejected. However, in view of a recent circular, the period has been extended to five years.
Considering the nature of dispute, I dispose of the writ application with a direction to the Central Board of Secondary Education to correct the father's name of the petitioner by substituting 'Masoom Reza' in place of 'Masoom Raza' in the mark sheet of Class-12 of year 2015, Migration Certificate and all other documents subsequent thereto.
The application is allowed with the aforesaid direction. (Chakradhari Sharan Singh, J) N.H./- U
