JUSTICE ARUN KUMAR ORAL ORDER 23-01-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Mahila P.S.Case No. 3 of 2015 registered under Sections 342, 354B, 379, 386 and 504/34 of the Indian Penal Code. Allegation in brief is that one Mandhir Singh called the informant from his mobile, she went his house where petitioner and some unknown persons with Mandhir Singh were present and asked her to compromise the case lodged against this petitioner and when she refused, accused persons undressed her and videography was done.

Learned counsel for the petitioner submits that there is enmity with the petitioner, as earlier a case under Section 307 of IPC was filed against the petitioner and therefore again this false case was lodged and there is no any recovery of any C.D. or any

No.58956 of 2017 (4) dt.23-01-2018 2/2 other material from him and as per allegation informant was called by Mandhir Singh, who has been admitted to bail by the court below and one of the co-accused similarly situated has been admitted to bail by a co-ordinate Bench of this Court vide order dated 05.06.2017 passed in Cr. Misc. No. 21116 of 2017. Having considered the aforesaid facts and circumstances, the petitioner, namely, Raju Yadav is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM-I, Munger in connection with Mahila P.S.
