2. Petitioner seeks regular bail in connection with Shambhuganj P. S. Case No. 293 of 2024 in a case registered for the offences punishable under Sections 137(2), 140(3) of the Bharatiya Nyaya Sanhita.
3. As per the prosecution case, on 14.10.2024, son of informant, namely, Ayush Kumar @ Kishan Kumar went to visit Durga temple at 5 PM, but did not return. Thereafter, informant and his relative started searching him but he was not found. F.I.R., has been lodged against unknown.
4. Learned counsel for the petitioner submits that petitioner is quite innocent and has falsely been implicated in
Patna High Court CR. MISC. No.42670 of 2025(2) dt.08-08-2025 2/2 this case only on the basis of confessional statement. Petitioner is nowhere involved in the alleged occurrence. Petitioner is in custody since 19.03.2025, having no criminal antecedent.

However, learned counsel for the informant vehemently opposes the prayer for bail and submits that it is a case of honour killing, in which, all the accused persons, including this petitioner, committed murder of son of informant on the suspicion that son of informant had love affair with one Amrita Kumari. Name of this petitioner surfaced on the basis of confessional statement of injured (Ayush Kumar). Post-mortem report reveals that multiple injuries were found on the body of deceased Ayush Kumar
6. Considering the nature of accusation, material available on record and gravity of offence, the prayer for bail of the petitioner is rejected.
