13-12-2016 Heard Sri Manish Kumar, learned counsel for the petitioner and Sri Bharat Lal, learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Araria (Bairgachhi) P.S. Case No. 462 of 2016 registered for offence under Sections 341, 323, 406, 379, 506/34 of the Indian Penal Code, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that in a civil dispute, colour of criminal offence has been given. He submits that there was some dispute in respect to payment of cash amount regarding hiring of the thresher of the informant. Learned counsel for the petitioner, by way of referring to Annexure - 2 to the present petition, submits that from the petitioner's side also, a complaint was filed against the informant
Patna High Court Cr.Misc. No.49024 of 2016 (2) dt.13-12-2016 2/2 side for offence under Sections 341, 323, 504, 307, 379/34 of the Indian Penal Code. According to learned counsel for the petitioner that as per agreement, entire payment was made, but the informant has maliciously filed the present case.
However, after going through the material on record and keeping in view the nature of accusation, in the event of arrest or surrender within a period six weeks from today, let the petitioner namely Md. Sayek Alam @ Md. Sayak be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Araria in connection with Araria (Bairgachhi) P.S. Case No. 462 of 2016 subject to condition as laid down under Section 438(2) of the Cr.P.C.
