JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-12-2015 Heard learned counsels for the petitioner and the State. The petitioner being the unmarried sister of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 328, 302 and 120B/34 of the Indian Penal Code.
The prosecution case is of killing the daughter of the informant after 15 years of the marriage by making assault and administering poison.
It is submitted by learned counsel for the petitioner that accusation is omnibus and general against entire in-laws family and admittedly, the informant is not the eye-witness to the occurrence. The impugned order also does not suggest any direct material collected during investigation against the petitioner.

No.55655 of 2015 (2) dt.08-12-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Darbhanga in connection with Jalley P.S. Case No. 95 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
