The petitioner seeks bail in connection with Kargahar P.S. Case No. 167 of 2020 instituted for the offences under Sections 302, 328 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that though the marriage was 18 years old and no case in between the aforesaid period was instituted either by the deceased or by the informant but now after the death of petitioner's wife (deceased), the informant falsely implicated him alleging that he killed his daughter by poisoning.
Learned counsel for the petitioner fairly submits that
Patna High Court CR. MISC. No.52997 of 2021(3) dt.02-03-2022 2/2 charges have been framed and trial is going on and out of six witnesses, two witnesses have been examined.
At this stage, learned counsel for the petitioner seeks permission to withdraw the present bail application. Permission is accorded with liberty to the petitioner to renew his prayer for bail in the event if the trial is not concluded within a period of six months from the date of receipt/production of a copy of this order.
The learned court below will ensure that the trial is completed within the aforesaid period.
Accordingly, the present bail application is dismissed as withdrawn with the liberty aforesaid.
