ANJANA MISHRA ORAL ORDER 17-09-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Sandesh P.S. Case No. 28 of 2016 registered for the offences punishable under Sections 341, 323, 420, 406 and 504/34 of the Indian Penal Code.

On the last occasion, this Court after hearing the learned counsel for the petitioners had directed them to deposit Rs. 35,000/- in the court below subject to the result of the present prosecution. The said amount has since been deposited in court. Notices were also issued to Opposite Party No. 2 but despite valid service they have not appeared.

No.26839 of 2016 (3) dt.17-09-2016 2/2 In view of the facts and circumstances of the case and the nature of allegation, let the above named petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 9th Additional Chief Judicial Magistrate, Bhojpur at Ara in connection with Sandesh P.S. Case No. 28 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
