====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 21-03-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

This application has been filed on behalf of the petitioner for modification of the order dated 07.09.2017 passed in Criminal Misc. No.4794 of 2017 by this Court with regard to extend the period of surrender of the petitioner in the court below in connection with Bhojpur Mahila P.S. Case No.319 of 2016.

Learned counsel for the petitioner submits that vide order dated 07.09.2017 passed in Criminal Misc. No.4794 of 2017 by this Court, the petitioner was directed to be released on bail, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of the aforesaid order, on furnishing bail

Patna High Court Cr.Misc. No.16081 of 2018(2) dt.21-03-2018 2/2 bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Ara, Bhojpur, in connection with Bhojpur Mahila P.S. Case No.319 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C. but due to some reason, the petitioner could not surrender before the court below in connection with the concerned case within time and prays for extension of period of surrender of the petitioner in the court below in connection with the concerned case.

In view of the aforesaid submission, let the period of surrender of the petitioner in the court below in connection with the concerned case be further extended for a period of four weeks from today. With the aforesaid modification in the order dated 07.09.2017 passed in Criminal Misc. No.4794 of 2017 by this Court, this application stands disposed of.
