2. The petitioner apprehends her arrest for the offences alleged under Sections 406, 420, 506 and 120B IPC registered in connection with Complaint Case No. 495(c) of 2010.
3. It is submitted that the petitioner has been falsely implicated as almost the entire amount was paid by the complainant to her husband late Prakash Chandra Das who was the Managing Director of M/s. Magadh Colonizers Pvt. Ltd., Patna towards purchase of a flat. It is further stated that the complainant himself was a witness to the tripartite development agreement by which the construction of Vimla Tower project was transferred by Magadh Colonizers Pvt. Ltd., to Smt. Usha Sharma,
Patna High Court Cr.Misc. No.39906 of 2012 (7) dt.10-03-2015 Managing Director of M/s. Vaishnavi Architect and Engineers Pvt. Ltd., and as such it cannot be said that the complainant was cheated by the petitioner. Similarly situated co-accused Binod Kumar has been granted anticipatory bail in a detailed order passed in Cr. Misc. No. 38818 of 2012 by this Court.
4. Pursuant to issuance of notice by order dated 11.10.2012 in Cr. Misc. No. 38818 of 2012 along with which the present case was taken up, the complainant has duly appeared and filed Vakalatnama.
5. Having regard to the entirety of the facts and circumstances, in the event of the petitioner's arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Ms. Rashmi, learned J.M. Ist Class, Patna, in connection with Complaint Case No. 495(c) of 2010 subject to the conditions as laid down under Section 438 (2) Cr.P.C.
