The petitioner is apprehending arrest in a case registered for the offences punishable under sections 272 and 273 of the Indian Penal Code and section 47(a) of the Excise Act. It is alleged that 350 liters of country made liquor were recovered from the manufacturing unit alleged to have been run by the petitioner.

It is submitted by the learned counsel for the petitioner that there is nothing on record to show that the place of seizure either belongs to the petitioner or he was operating the said alleged manufacturing unit. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

No.54558 of 2015 (2) dt.02-12-2015 2/2 The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Mufassil P.S. Case No. 374 of 2015 pending in the court of learned CJM, Gaya. This application is disposed of with the aforesaid observation/direction.
