The petitioners seek bail in Garkha P.S. Case No. 254 of 2016 registered under Section 366 A/34 of the Indian Penal Code.

Minor daughter of the informant is said to have been kidnapped by the Tinku Manjhi in association of the petitioners. It is submitted by learned counsel for the petitioners that the petitioners have been falsely implicated in this case. The allegation levelled against the petitioners are not specific rather general and omnibus in nature. Petitioners happen to be student and have no concern with the aforesaid occurrence. Patna High Court Cr.Misc. No.58746 of 2017 (04) dt.02-02-2018 - 2 - her statement under Section 164 Cr.P.C. has claimed petitioners to be innocent and she is major. The petitioners have been languishing in custody since 27.08.2017.

In the facts and circumstances of the case, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Saran at Chapra in connection with Garkha P.S.
