2. The petitioner apprehends his arrest in a case registered for the offence under Sections 147, 148, 149, 341, 323, 324, 307, 327, 379, 504 and 506 of the Indian Penal Code.

3. As per the prosecution case, on the alleged date and time of occurrence, in order to grab the land of the informant, all the accused persons named in the F.I.R. including this petitioner tried to cultivate the land of informant and on protest, the accused persons abused and assaulted informant and his family members by lathi and danda.

4. Learned counsel for the petitioner submits that due to land dispute between the parties, petitioner has been made

Patna High Court CR. MISC. No.46523 of 2024(2) dt.12-08-2024 2/2 accused in this case. There is no allegation of overt act against this petitioner. Petitioner is only alleged to have snatched gold chain alongwith co-accused Md. Anis, which is ornamental in nature in order to make the case grave.

5. Learned A.P.P. for the State and learned counsel for the informant vehemently opposed the prayer for anticipatory bail.

6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Purnea in connection with Dagarua P.S. Case No. 45 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
