JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-11-2018 Petitioner prays for bail in connection with Sessions Trial No. 267 of 2018, arising out of Samastipur Town P.S.Case No. 04 of 2018 registered for the offence punishable under Section 392 of the Indian Penal Code.

Allegation as per FIR is that some miscreants entered inside the UCO Bank, Gola Road, Samastipur and looted cash and other articles and petitioner is not named in the FIR and later on it appears that he was arrested and Rs.2500/- was recovered from his house and it further appears that he is accused in one more case.

Submission of learned counsel for the petitioner is that the amount of Rs.2500/- is not the looted cash amount, rather he has withdrawn the said amount from the bank, which will appear from Annexure-2 and except that nothing has been

Having heard both sides and in the facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the 3rd. Additional Sessions Judge, Samastipur, in connection with Sessions Trial No. 267 of 2018, arising out of Samastipur Town P.S.Case No. 04 of 2018, G.R.No. 32/18/27/18, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
