Learned counsel for the petitioner, prays for and is allowed to correct the address of the petitioner, during the course of the day.
The petitioner seeks bail in N.D.P.S Case No. 52 of 2017 arising out of Raxaul P.S. Case No. 179 of 2017, registered for the offence punishable under Sections 20, 22, 23 and 24 of the NDPS Act.
Allegation against the petitioner is of recovery of 185 grams of opium from his possession.
It has been submitted by the learned counsel for the petitioner when he was returning after meeting the patients in
Patna High Court Cr.Misc. No.61153 of 2017(3) dt.16-01-2018 2/2 Duncon Hospital, he was apprehended by the police and has been falsely implicated in this case. It has been further submitted that the petitioner has got no criminal antecedent and is in custody since 07.06.2017.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with NDPS Case No. 52 of 2017 (Corresponding to G.R. No. 23 of 2017).
