Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and 47A of the Excise Act. The prosecution case is that 54 sachets country made liquor, each containing 400 ml. were recovered from the house of the petitioner.

It is submitted by the learned counsel for the petitioner that recovery is from the joint family house of the petitioner. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a

Patna High Court Cr.Misc. No.54089 of 2015 (2) dt.30-11-2015 period of six weeks from today in connection with Fulwariya P.S. Case No. 123 of 2015, pending in the court of learned Sri Abhishek Kunal, Judicial Magistrate, Ist Class, Gopalganj. With this observation this application is disposed of.
