Petitioner seeks bail in Special Case No.11 of 2017 arising out of Agamkuan P.S. Case No.44 of 2017 registered under Sections 419, 420, 467, 468, 471, 120(B) and 34 of the IPC, under Section 66D of the I.T. Act and under Sections 7, 8, 9, 13(1)(c)(d) read with Section 13(2) of the Prevention of Corruption Act.

Learned counsel for the petitioner submits that the prayer for bail of the petitioner was earlier twice rejected by this Court vide order passed in Cr.Misc.No.33675 of 2017 and Cr.Misc.No.53402 of 2019. Almost all the accused persons including the Chairman, Bihar State Staff Selection Commission

Patna High Court CR. MISC. No.1861 of 2021(5) dt.10-02-2021 2/2 have already been granted bail. The petitioner is in jail for last four years. The name of the petitioner surfaced during the course of investigation. Therefore, the petitioner may be enlarged on bail.

Learned counsel for the Vigilance submits that the petitioner has got criminal antecedent and he is an accused in another case of similar nature but the petitioner remained in jail for about four years and other accused persons have been granted bail. Learned A.P.P. has not disputed the facts. Having considered the facts and the nature of allegations made against the petitioner and the fact that the petitioner has not moved before the Hon'ble Supreme Court, the petitioner remained in jail for about four years and other accused persons have been granted bail, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned Special Judge, Vigilance 1st, Patna in connection with Special Case No.11 of 2017 arising out of Agamkuan P.S.
