JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2019 This is an application for grant of anticipatory bail in connection with Siwan (Mufassil) P.S. Case No. 438 of 2017, disclosing offences under Sections 147, 148, 149, 323, 332, 333, 353, 188, 294, 290, 291 of the Indian Penal Code, Section 9 of the Bihar Control Loud Speaker Act and Sections 2/4/4/10 of POCSO Act.

Allegation against the petitioner and several other accused persons is of playing the D.J. song along with lady dancer and further allegation of creating unlawful assembly and disrupting the traffic.

Submission of learned counsel for the petitioner is that nothing specific has been attributed against the petitioner and he has no criminal antecedent.

Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge cum Special Judge, Siwan, in connection with Siwan (Mufassil) P.S. Case No. 438 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
